Terms of Use

These terms govern the use of the SolarSimPro solar power plant design and simulation software (the "Service") offered at solarsimpro.com. By creating an account you are deemed to have accepted these terms.

1. Scope of the Service

SolarSimPro is a browser-based subscription (SaaS) service providing design, analysis, shading and energy simulation, and deliverable generation for ground-mounted and rooftop solar plant projects. The results produced constitute a preliminary engineering assessment; obtaining approval from a qualified engineer for final construction designs is the user's responsibility.

2. Account and Security

• Email verification is mandatory at registration. Providing a mobile number is optional; if provided, only one account may be opened per phone number.
• You are responsible for keeping your account details and password confidential.
• Licences are per user; the Service may be suspended if account sharing is detected.

3. Subscription, Fees and Renewal

• Plans and current fees are published on the registration page . Prices are set in US dollars (USD); payment is collected in Turkish lira (TRY) at the Central Bank of Türkiye selling rate on the transaction date. Prices exclude VAT.
• The subscription renews automatically at the end of each period and is charged to your stored payment method. You may stop renewal at any time from your account page or by writing to info@solarsimpro.com; cancellation takes effect from the beginning of the following period.
• Payments are processed through iyzico; your card data is not stored by us.

4. Intellectual Property

All rights in the software, interface and content are reserved. The user owns the project data they create; the user may not copy, reverse-engineer or sublicense the software to third parties.

5. Nature of Technical Outputs and the User's Duty to Verify

• Responsibility for inputs: The accuracy, currency and completeness of all data entered into the Service — including site boundaries, terrain and roof geometry, elevation data, module and equipment values and obstacles — is solely the User's responsibility. The Provider cannot be held liable for any consequence arising from outputs generated from incorrect or incomplete input.
• Duty to verify: Before relying on any output, the User is obliged to verify it against site surveys, current official records (title and cadastral records, zoning status and similar), manufacturers' technical documentation, and applicable legislation and standards. Relying on outputs without such verification means the User assumes all resulting consequences.
• Professional approval requirement: Outputs may be used for permits, applications, manufacturing, installation or investment decisions only after review and approval by engineers authorised to sign under the applicable legislation. Failure to obtain such approval is the User's fault.
• Nature of estimates: Energy yield estimates are based on meteorological data sets, modelling assumptions and statistical methods. Actual generation may deviate from these estimates; such deviations create no obligation for the Provider.

6. Limitation of Liability and Indemnity

• The Service is provided "as is" and "as available"; fitness for a particular purpose, uninterrupted operation and freedom from error are not warranted.
• All direct or indirect, pecuniary or non-pecuniary damages arising from the User's use in breach of these terms (in particular Article 5) rest solely with the User.
• The Provider is in no way liable for loss of profit, loss of generation or revenue, loss of data, business interruption, reputational damage, or any other indirect, incidental or consequential loss.
• Save where liability cannot be excluded by law, the Provider's aggregate liability under this agreement is in all cases limited to the amount paid by the User for the most recent relevant subscription period.
• Indemnity: The User agrees to fully indemnify and hold the Provider harmless against any claim, action or loss arising from the User presenting or making available the Service's outputs to third parties (employers, clients, authorities and the like).
• Force majeure: The Provider cannot be held liable for circumstances beyond its control, such as natural disasters, infrastructure or communications outages, or failures of third-party services (hosting, payment, SMS).

7. Changes

These terms may be updated; material changes will be notified to your registered email address.

8. Disputes

These terms are governed by the laws of the Republic of Türkiye; the courts and enforcement offices of Ankara have jurisdiction over disputes. Users who qualify as consumers retain the right to apply to consumer arbitration committees and consumer courts.
